PharmaStem Infringement Overturned
15 September 2004
The Delaware District Court has overturned a jury verdict of infringement on PharmStem's US Patent No. 5,004,681. The Court finds that the jury verdict was "against the great weight of the evidence", and a new trial is awarded to the co-defendants (links to press releases): Viacell, Cryo-Cell, CorCell, and CBR.
In addition, the Court has ruled that private cord blood banks are not liable for contributory infringement of PharmaStem's US Patent No. 5,192,553 because they merely offer a preservation service, and are not in the business of selling cord blood.
Similarly, OB/Gyn's are not liable for contributory infringement of the '553 patent.
